After years of delays, broken promises and code violations, the troubled Daibes retail/housing project at Burnett and Springfield avenues is apparently at an end.
The Township Committee on Tuesday voted, 5-0, to terminate its agreement with Daibes Construction as of Oct. 21. The project dates back to 2010 when it was announced with great fanfare.
But several times in recent years, the Township has had to complain to the developers about missing deadlines for permits and other needs. Construction has stopped and started on several occasions.
"It's very frustrating, " TC member Jerry Ryan said Tuesday. Mayor Vic De Luca called the whole situation, "a real headache."
Township Attorney Roger Desiderio recommended that the TC vote to terminate the agreement Tuesday after detailing the developer's string of unacceptable acts.
"The property has been transferred on two separate occasions from the original developer to two subsequent developers, all without the consent and approval of the governing body, which is a violation of the redevelopment agreement," he said. "They also failed to comply with the construction schedule. Based on all of that it is our recommendation that the Township issue a termination notice to Daibes."
He said the termination could be changed if Daibes can "explain why, offer some solutions to cure the defects and then it will be up to the governing body to accept that or let the termination go into effect."
